    • It is not known for certain where James of Spreyton was born. The only family living in the area prior to 1700 were living in nearby Hittisleigh where some Malletts were recorded in the parish registers between 1679 and 1704. Unfortunately, the registers recording BMD events in Hittisleigh prior to 1676 have been lost or destroyed. A few Bishops Transcripts have survived but only as fragments of fire damaged books, so it is impossible to determine how long the Malletts may have been there. It should be noted that it is only a very small parish with only a few houses, but there was a mill at Hittisleigh, which may be of relevance to the notes below.

      Because Benjamin of Hittisleigh and James of Spreyton lived in neighbouring parishes at the same time, it is reasonable to assume that they may have been brothers.

      In 1710, James was involved in a legal dispute with the Executors of the Will of a Robert Burgoyne, who owned South Tawton Mill prior to his death. James claimed that the lease of the mill was promised to him by Robert and he felt that the Executors had cheated him. He took the matter to court and Chancery Proceedings of the case still survive and are kept in the National Archives at Kew in London. It is not known what the outcome of the case was, but it should be said that none of James's decendants were involved in milling. A distant branch of the Mallett family, descendants of Robert Mallett of Dowland, were well known for being millers in the Crediton and Tiverton areas for many generations. This case is the only indication that James came from a privileged background, because it was unlikely that anyone of a status below a Yeoman would have pursued (or could afford) a legal dispute like this one.

      There was a James Mallett born in 1677 at Morval near Fowey in Cornwall and some of the Cornish Malletts were known to be millers. Though Robert Burgoyne owned property in South Tawton, his family seat and other property holdings were in the Liskeard area in the neighbouring county of Cornwall and the Executors of his Will also came from that area. A branch of the Mallett family was well established in the same area at St. Neot and Menheniot. However, despite these circumstantial links, it has not been possible to prove (or disprove) any documented connection between the Malletts in Cornwall and those in the South Tawton area.
